Definitions: In these Terms and Conditions, "CFL" refers to CFL Crossfreight Line AG, "goods" refer to the items being transported by CFL, "consignee" refers to the recipient of the goods, and "freight forwarder" refers to CFL as the party providing freight forwarding services.

  1. Scope of Services: CFL agrees to provide freight forwarding services to the customer, including but not limited to ocean freight, customs brokerage, and inland transportation.
  2. Liability: CFL's liability for loss or damage to the goods shall be limited to the lesser of the actual value of the goods or the amount specified in CFL's insurance policy. CFL shall not be liable for any indirect or consequential damages arising from the transportation of goods.
  3. Insurance: CFL shall provide insurance coverage for the goods during transportation as specified in the customer's contract. The customer shall be responsible for providing accurate and complete information regarding the value and nature of the goods to be transported.
  4. Documentation: The customer shall provide all necessary documentation required for the transportation of goods, including but not limited to shipping documents, bills of lading, and customs declarations. CFL shall not be responsible for any delays or damages arising from incomplete or inaccurate documentation provided by the customer.
  5. Payment: The customer shall pay CFL for its services according to the payment terms specified in the customer's contract. CFL may withhold delivery of the goods until all outstanding payments have been received.
  6. Termination: Either party may terminate the agreement between CFL and the customer in the event of a material breach of the agreement by the other party or if one party becomes bankrupt or insolvent.
  7. Dispute Resolution: Any disputes arising from the transportation of goods by CFL shall be resolved through mediation, arbitration, or litigation as agreed upon by both parties.
  8. Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of Switzerland, and any legal action arising from the transportation of goods shall be brought in the courts of Switzerland.
  9. Miscellaneous: These Terms and Conditions constitute the entire agreement between CFL and the customer and supersede any prior agreements or understandings, whether written or oral. These Terms and Conditions may only be modified in writing signed by both parties.
